Best ways to protect your rights if you're pulled over for DUI
If you are pulled over for driving while intoxicated follow these simple guidelines to protect your rights.
You have the right to NOT answer questions.
Officers ask questions related to drinking, driving, medications, etc.
You have the right to NOT perform field sobriety tests.
Officers will tell you to perform certain coordination tests.
You have the right to NOT take the PAS test*
The PAS is a handheld device used at the scene to test breath for alcohol.
Police use these questions and tests to build a case against you. Be respectful but do not answer questions or perform these tests. If you are arrested, you must submit to a breath test or blood test at the police station. You DO NOT have a right to refuse that test.
*Exceptions: If your are under 21 years old or on probation for a DUI, then you ARE required to take the PAS test.
